Estas condiciones de uso están disponibles en inglés y en francés. La versión en inglés, que tienes a continuación, es la que prevalece.
These terms apply to the Pointster app, published by Julien Duribreux EI, trading as Midnight Voxel ("we", see the legal notice). By using the app, you accept them. If you don't, please don't use it.
If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms complete it.
Using the app
You may use the app on any device you own or control. You may not:
- copy, modify, sell or redistribute the app, or extract its source code, except where the law allows it;
- get paid features without paying for them, for example by tampering with the app or its purchases;
- use the app to break the law or to harm other people, including through the names, pictures or other content you add or share.
Your data
Your games, players, pictures and statistics are stored only on your device: we have no copy and can't recover them. Uninstalling the app or deleting your data erases them for good, so create a backup from the app before you change phones. The privacy policy explains what the app sends, and to whom.
You are responsible for what you add. Only add the names and pictures of people who agree to it, especially when you stream a game to nearby phones or share a card.
Ads, plans and unlocks
The app is free and shows ads. Basic, Advanced and Premium are one-time purchases that remove the ads and unlock features, as the app describes them when you buy. They are sold by the App Store or Google Play under the store's terms: the store takes the payment and handles refunds and the right of withdrawal, and we never see your payment details. A plan belongs to your store account: tap Restore purchases in Options to get it back on a new device.
On the free version, watching a rewarded ad can unlock some features for a limited time, as the app shows. How many unlocks you can earn each day, and how long they last, may change.
Changes to the app
We update the app regularly and may change, add or remove features. We work to keep it reliable, but we can't promise that it will always be available, free of errors or compatible with every device.
Liability
As far as the law allows, we are not liable for indirect losses, such as lost data. Nothing in these terms limits your rights as a consumer, in particular the legal guarantee of conformity for digital content, nor any liability that the law doesn't allow us to limit.
Intellectual property
The app, its name, Klik the mascot, its design and its content belong to Julien Duribreux. Game names in the catalog belong to their owners and only identify the games.
Changes to these terms
We may update these terms. The date at the top of this page shows the latest version. If you keep using the app after a change, the new terms apply. If you don't accept them, stop using the app and delete it.
Applicable law
These terms are governed by French law. If you live in another country of the European Union, you also keep the protection of its mandatory consumer law. If something goes wrong, write to us first: most problems are solved by email. Otherwise, the competent courts decide.
These terms exist in English and French. If the two differ, the English version prevails.
